RERA Complaint in Haryana
Introduction

The State of Haryana and on the other hand has recorded tremendous growth in infrastructure, it has also become the center of many scams and complaints involving high-level individuals. With the growth of the industry, no. in the news, complaints and fraud have also increased. Due to a lack of specific regulations or a grievance redressal agency, by the consumer against the builder or vice versa, it has not been properly addressed.

However, the RERA Regulation provided significant assistance and established a separate appeal authority in the real estate sector. Let's understand the RERA rules and grievance redressal system in Haryana.

RERA in Haryana

RERA, a set of laws, regulations and the Government's mandate to ensure (i) accountability, (ii) sustainability, (iii) grievance redressal, especially the real estate industry. The Real Estate (Regulations and Development) Act, 2016 came into effect on 01/05/2017.

As required by the RERA Act, the State of Haryana notified its final rules of Haryana RERA, 2017 dated 28/07/2017 determining its regulation, form and procedure;

  • The constitutions of the RERA authorities

  • Filing complaints before RERA authorities

  • Grievance redressal system

Common complaint before RERA

Some of the most common issues a consumer faces before a RERA authority / RERA Judicial Officer are as follows:

  • Property management delays.

  • No refund from the Builder.

  • There is no compensation for the delay as promised

  • Registration delay

  • An unnecessary need for builders

  • Non-payment of late payment etc.

Filing a RERA complaint in Haryana

Following this so far, the RERA website in Haryana has not been launched, which is why any complaint will be lodged in person at the Panchkula office. The RERA complaint in Haryana can be filed before following the authorities according to the nature of the complaint.

Complaint to the RERA Judicial Officer -

(1) Any aggrieved person may lodge a complaint with a judicial officer

interest and compensation as provided under sections 12, 14, 18 and 19 in

and the time of the hearing and will be notified by plaintiff;


(d) On the due date, the presiding officer shall explain it to the person who responds to the alleged violation of the law

in respect of any provision of the Act or the rules and regulations made under and when respondent,


(i) pleading guilty, the presiding officer shall record

pleading, and order in writing, order payment of interest such as referred to in rule 15 and compensation as he sees fit

it is appropriate, as it may be, subject to conditions of Laws or laws and regulations, made under it;


(ii) does not plead guilty and object to an appeal, i the judge must seek and explain from

defendant;


(e) in the event that the judicial officer is satisfied on the basis of the submissions made the complaint not need to proceed investigation, may dismiss the complaint;


(f) in the event that the judicial officer is satisfied on the basis of Presentations made it necessary to continue the audio file of complaint, may order the production of documents or other evidence on the date and time specified by him;


(g) the judicial officer shall have the power to investigate on a complaint based on documents and submissions;


(h) the judicial officer shall have the power to summon and enforce to attend to anyone who knows the facts too the circumstances of the case for giving evidence or for producing any

documents in the opinion of the judicial officer, which may be is useful or relevant to the subject matter, as well as practical such evidence.


(i) on the due date, the judicial officer when considering evidence presented before him and other records and submissions by satisfied that the respondent, -

(i) is liable to pay interest and compensation, as the case may be either, by the judicial officer, by written order, by order

payment of interest as defined in rule 14 as such

compensation as he sees fit.


(ii) not be liable for any interest or compensation, as the case may be

either, a judicial officer, by command in writing,

(j) if any person fails, neglects or refuses to appear, or presents himself as

or response to notice of appeal, as the case may be.

The RERA Judicial Officer, after following the prescribed procedure, will dismiss the appeal within 60 days of filing. If it is not discarded within the allotted time, the officer will record the reasons.

Complaint to Haryana RERA Authority -

(1) Any aggrieved person may lodge a complaint with the Authority

violation of the provisions of the Act or the rules and regulations made

below, save as those given a sentencing judgment

set out in Schedule III in the form of a demand framework or bank check

(2) The Authority must for the purposes of determining any appeal as

referred to under rule (1), follow the summary of the investigation process in

the following, namely: -

(a) upon receipt of the complaint, the Council shall issue a notice

and details of alleged violations and justifications

documents to the respondent stating the date and time of the hearing;

(b) the respondent to whom the notice was issued under subsection (a) of

subregulation (2), will submit its response to the complaint within -

time as defined in the notice;

(c) the notice shall set a date and time for the continuation of the hearing and the date

and the time of the hearing and will be notified by

plaintiff;

(d) On the due date, the Authority shall inform the respondent

about alleged violations committed in connection with

any provisions of the Act or rules and regulations made

below and if the respondent.

(i) If you plead guilty, the Authority will record your request, and then forward it

instructions including the imposition of a fine as it deems fit accordingly

by the provisions of the Act or the rules and regulations, made

below;

(ii) does not plead guilty to the charge and object to the appeal, the Authority

will seek an explanation from the respondent;

(e) in the event that the Authority is satisfied on the basis of the representations made

that the complaint does not require further investigation, we may dismiss it

a complaint with reasons for the recording;

(f) in the event that the Authority is satisfied on the basis of the representations made

that there is a need for further hearing of the appeal, may be ordered

production of documents or other (evidence) by the due date and time

with it;

(g) The Authority shall have the power to investigate the matter

complaint on the basis of documents and submissions;

(h) The Authority shall have the power to summon and enforce

to attend to anyone who knows the facts and circumstances

guilty of giving evidence or presenting any documents in

Evidence Act, 1872 (11 of 1872);

(i) on a specified date, by the Authority in the case of evidence

including the imposition of a fine as it deems fit in terms of

the provisions of the Act or the laws and regulations made

below;

(ii) the respondent does not violate the provisions of the Act

or laws and regulations under which it is made,

by written order, dismissing the complaint, you have reasons to be so

written recording;

(j) if any person fails, neglects or refuses to appear, or presents himself as

required before the Authority, the Authority shall have this power

to record reasons for doing so.

(3) The procedure for the day-to-day running of the Authority,

not provided by the Act or the laws made under it, shall be as

defined by the regulations made by the Authority.

(4) Where the appellant party is represented by an authorized person,

as provided under section 56, a copy of the authorization to do so again

written consent to that authorized, both original, must

lodged a complaint or response to a notice of appeal, as

case possible.

Complaint to Haryana RERA Tribunal -

The RERA tribunal is the second appeal authority.

Any person who has been harmed by an order of the RERA authority or judicial officer

May he file a complaint with the Haryana RERA court in three "AAT" forms

Within 60 days from the date you received the order

After payment of the prescribed fee in terms of Schedule III Rs. 1000 / - and Rs. 10 each suffix. The RERA Tribunal, after following the prescribed procedure, will dismiss the appeal within 60 days of filing. If it is not discarded within the allotted time, the officer will record the reasons.

Step to Register a Complaint

Step 1: Go through the HRERA (filing of Complaints) Regulations carefully


Step 2: Go to the Home Screen of HRERA Gurugram web portal and click on tab Complaint Registration


Step 3: Fill up the complaint registration form and follow the steps prompted by the system.


Step 4: After submitting the form, you will receive an online complaint no from system. This complaint number will be used for all future correspondences.


Step 5: Make payment of requisite fee, Complaints fees @ Rs.1000 per complaint plus Rs.10 per annexure attached with the complaint by way of Demand Draft in favour of Haryana Real Estate Regulatory Authority Gurugram, payable at Gurugram/ Online Payment Gateway


Step 6: Take a print out of i) Registration Form (Performa-B) and make (Two + number of respondent) copies.


Step 7: Separately type out the detailed Complaint in the format prescribed in the Regulation dated 16.02.2018. Make (Two + number of respondents sets of complaints) and attach with the documents at Step 6


Step 8: Annex a copy of a certificate declaring that a self-signed copy of complaint has been sent to the Respondent directly through speed post and email. After delivery of complaint attach tracking report and email report as a proof of service.


Step 9: Physically deliver 02 + Number of respondent copies of the set comprising of Complaint Registration Form and Annexure and Demand Draft of Fees Paid and Detailed Typed Complaint and Selfdeclared and signed certificate (Step 8) in the office of Authority by hand.


Step 10: Check the status of complaint regularly at https://haryanarera.gov.in by entering the complaint details.


Step 11: Submit a soft copy of the complaint in word format and complete complaint with annexure in pdf format.
