RERA Complaint in Punjab

Punjab has many business opportunities in the Real Estate sector and has seen a high trend towards development in the Real Estate. The trend in this sector has obviously provided significant development in the province of Punjab but there has also been a significant increase in the percentage of affected home buyers.

The RERA Act, 2016 has come to light and the purpose of this law is to address consumer complaints in homes. Builders are now no longer free to do anything on their own as there are proper rules for committing a bad act by builders. Let's discuss the impact of RERA on Punjab:

RERA in Punjab

The RERA (Real Estate Regulatory Authority) Act has been suspended from 01/05/2017 for the purpose of ensuring (i) accountability, (ii) stability, (iii) grievance redressal, in the real estate industry.

As required by the above RERA Act, the Government of Punjab notified its final Punjab RERA Act, 2017 dated 08/06/2017 determining its regulation, form and procedure;

Filing a RERA complaint in Punjab 

All real estate rights are now vested with the State RERA and so now the consumer courts and consumer courts are no longer in the picture, one has to lodge all complaints about real estate as set out under the RERA Regulations before the State RERA authorities.

The filing of RERA complaints is a professional matter and requires a deep understanding of the rules and facts and circumstances of the case. Without expert advice a person can lose all standing in this case and it can also lead to loss of time and money.

The RERA complaint in Punjab can be filed before following the authorities according to the type of complaint.

(i) Appeal to the Chief Justice of the RERA - Any complaint relating to interest and compensation, referred to in sections 12, 14, 18 and 19, of the RERA Act, 2016, may be lodged on the 'N' form before the Punjab RERA Judicial Officer. The appeal will be filed with Rs. 1000 / -.

(ii) Complaint to Punjab RERA Authority -

Any complaint regarding a breach of the RERA Act, or the RERA Rules and Regulations,

Apart from those that may be included with the RERA judicial officer,

It can be filed before the RERA Authority on a physical 'M' form.

After paying the prescribed amount of Rs. 1000 / -.

The RERA Officer, after following the prescribed procedure, will dismiss the complaint within 60 days of filing. If it is not discarded within the allotted time, the officer will record the reasons.

(iii) Appeal to Punjab RERA Tribunal - The RERA Magistrate's Court has a second appeal.

Any person who has been harmed by an order of the RERA authority or judicial officer

May apply to the Punjab RERA court for a physical "L" form within 60 days from the date of receipt of the order after payment of the prescribed fee
