RERA COMPLAINT IN UTTAR PRADESH
Uttar Pradesh is the most populous Government in India and because of its large population and in need of Real Estate. The introduction of the RERA Act, 2016 has provided a signal of relief for real estate buyers in Uttar Pradesh as the RERA law has given them the regulator and the appropriate authority when they can seek justice for their grievances.
RERA in Uttar Pradesh
The RERA (Real Estate Regulatory Authority) Act has been suspended from 01/05/2017 for the purpose of ensuring (i) accountability, (ii) stability, (iii) grievance redressal, in the real estate industry.
As required by the above RERA Act, the State of Uttar Pradesh notified its final rules of Uttar Pradesh RERA, 2017 on 27/10/2016 determining the regulation, form and procedure;

Filing a RERA complaint in Uttar Pradesh
Following the enactment of the RERA Rules in the UPS, all appeals relating to the sale of houses as set out under the RERA Regulations will be filed before the State instead of the consumer court or consumer forum or public court.
Preparing a RERA complaint and presenting it to a RERA official requires a proper approach. The RERA authority has been granted rights as if it were in a public court and that is why it needs to comply with decorating and other related practices.
The RERA complaint in Uttar Pradesh can be filed before the authorities follow up on the type of complaint-
(i) Complaint to the Chief Justice of RERA - Any complaint relating to interest and compensation, referred to in sections 12, 14, 18 and 19, of the RERA Act, 2016, may be lodged on Form 'N' before the Uttar Pradesh RERA Judicial Officer . The appeal will be filed with Rs. 1000 / -.
(ii) Complaint to Uttar Pradesh RERA Authority -
Any complaint regarding a breach of the RERA Act, or the RERA Rules and Regulations,
Apart from those that may be included with the RERA judicial officer,
It may be submitted to the RERA Authority in the form ‘M’ either in person or on its website
After paying the prescribed amount of Rs. 1000 / -.
The RERA Officer, after following the prescribed procedure, will dismiss the complaint within 60 days of filing. If it is not discarded within the allotted time, the officer will record the reasons.
(iii) Appeal to the Uttar Pradesh RERA Tribunal - the RERA tribunal is the second appeal authority.
Any person who has been harmed by an order of the RERA authority or judicial officer
can lodge a complaint with the Uttar Pradesh RERA Magistrate's Court on a physical "L" form or on its website within 60 days from the date of receipt of the order after payment of the prescribed fee.
